TERMS & CONDITIONS

All transactions made by Visa or Mastercard incur a 2% surcharge, all other payments must be paid 7 days prior to delivery.

All goods must be inspected before being signed for and any damages must be signed as such. Goods not correctly signed for may not be eligible for compensation. The packaging is part of your delivery and you are responsible for its removal.

Damages must be reported within 48 hours of the signed for date.

Estimate: An estimate by us shall constitute an offer. We may withdraw or amend any estimate any time prior to delivery. Changes to original estimate may result in an increase of price. All estimates are non refundable once production has commenced. The customer shall have the right to cancel this contract within 7 days of ordering without penalty. This estimate includes supply only of kitchen furniture, appliances and accessories.

Guarantee: This guarantee does not cover damage to the kitchen during or after installation. Hinges and all metallic moving parts are guaranteed for 12 months subject to regular maintenance by the customer. Cosmetic deterioration to fitted kitchen due to general ware and tear are not covered by this guarantee. The guarantee does not cover any penetration of insects, water and mould growth. Any minor imperfections of work tops, units and fascias are subject to supplier’s recommendations details of which are available on request. Stained timbers are not guaranteed against fading or discolouration. Kitchen products used in any installation are the closest colour match available from our suppliers at the present time (i.e.: It will not always be possible to have a perfect colour match of units and doors). All warrantees are given in good faith. However, if it is deemed after a visit from a company representative that our products have been miss-used, tampered or damaged in any way, we will render the guarantee null and void, leaving any remedial work to be carried out at a pre-arranged fee which shall be payable before any work commences. Any failure of materials under the terms of this guarantee will be repaired or replaced at company’s sole discretion. This guarantee is not transferable, all goods remain the property of the company until payment has been received in full and has cleared banking process. All Appliances / Accessories / Sink & Taps are covered under the Manufacturers warrantee. All Manufacturers warranties must be registered with the Manufacturer within 1 month.

Price: We reserve the right to make alterations to our price list, at our discretion. In particular, at any time and without notice, review the price payable to take into account increases in costs including and without limitation: materials, carriage, labour or overheads, the increase or impositions of any tax duty or other levy and any variation in exchange rate since the date of preparation of the current price list. Unless we otherwise agree in writing we reserve the right to charge you the cost of transportation of the goods to the destination requested by you. We reserve the right to charge carriage and a 35% exchange fee for all goods which are exchanged at your request.

Terms of Payment:     If you fail to make any payment on the due date then, without prejudice to any other right or remedy available to us, we shall be entitled to:
Cancel the contract or suspend any deliveries to you.

Be indemnified by you against all costs and expenses (including legal costs and expenses on a full indemnity basis) incurred by us in recovering sums due or in exercising our rights pursuant to our Terms of Payment.

As a member of the KBSA – Kitchen Bathroom Bedroom Standards Association, Niche Kitchens is continuously vetted to ensure that the Standards set for the Industry are maintained to the membership criteria. If payment is withheld the KBSA will provide an expert with an independent standing to handle any dispute fairly with both parties having the opportunity to state their position. Niche Kitchens will use a KBSA mediation service at the earliest stage should any dispute arise.

Delivery: Delivery will occur when the goods are ready for unloading at the delivery address. Full payment must be received and cleared before delivery. If you refuse or fail to take delivery or make payment of goods tendered in accordance with the contract we shall be entitled to store at your risk any goods of which you refuse or fail to take delivery, and you shall in addition to the purchase price pay all costs incurred as a result of your refusal or failure to accept delivery.
